FIA finds Gilani guilty in Hajj scam

ISLAMABAD: The Federal Investigation Agency (FIA) has found former premier Yousaf Raza Gilani guilty of corruption in the 2009 and 2010 Hajj operations, the Express Investigation Cell (EIC) has learnt.

According to reliable sources, the agency has referred Gilani’s case to the Special Judge (Central), Rawalpindi, under Section 175 of the Pakistan Penal Code so that he may be declared a proclaimed offender. They added that according to legal procedure, the special judge will summon the former premier before the court and ask him to surrender himself for further investigation in the case.

FIA uncovered Gilani’s involvement in the Hajj scam while investigating other suspects in the case, sources told the EIC. According to them, the former premier misused his authority during his tenure on two counts – to allocate a huge quota to several undeserving Hajj operators and to appoint Zain Sukhera as a grade 21 officer in the information technology (IT) ministry.

FIA had earlier issued a notice to Gilani on both counts. The former premier, however, refused to appear before the agency and cooperate with the investigations. He went on record, saying that no agency could question him over his actions as the prime minister since they lay beyond anyone’s authority.

Similarly, Gilani’s son Abdul Qadir is unwilling to join the investigation as well. According to the sources, the FIA wanted to inquire how Qadir purchased a costly bulletproof Land Cruiser in 2010. The former premier’s son also had FIA officials summoned before Parliament.

FIA investigations established that Sukhera had a fake degree and was not qualified to hold a senior post in the government. Furthermore, at the time of his appointment, he faced several criminal charges levelled both by the FIA and the National Accountability Bureau.

Sukhera was eventually dismissed by the Supreme Court from his post a year and half after he was appointed. He was forced to pay back all payments and perks he enjoyed as a grade 21 officer. Reportedly, this even included Rs921 for the stationery he used while in office.

ISLAMABAD: Name of Prime Minister Yousaf Raza Gilani’s son Ali Musa Gilani has surfaced in a Rs 7 billion drug scandal on Thursday.
The Supreme Court (SC) sought complete record from the Anti-Narcotics Force about granting out-of-turn quota for ingredient of medicine to two pharmaceutical companies by the Federal Health Ministry allegedly under the influence of Ali Musa Gilani.
A three-member bench – headed by Chief Justice of Pakistan (CJP) Iftikhar Muhammad Chaudhry – was hearing a civil petition, filed by the Islamabad Anti Narcotics Force (ANF) regional director versus Rizwan Ahmed Khan and others.
The court was informed that in violation of rules, quota of an ingredient for a medicine ‘ephedrine’ for cold, flu and asthma was granted and instead of 1,000 kilogrammes (kg) a quantity of 9,000kgs was allowed to Berlex Labs International and Denis Pharmaceutical. The ingredient – also known as “poor man’s cocaine”– was given to smugglers who spread it to drug addicts across Pakistan.
The matter was raised in the Lower House in 2009 where then health minister Makhdoom Shahabuddin formed a committee to give recommendations. Later, on the committee’s recommendations, the ANF initiated investigation against 10 people, including Dr Rashid Juma, Iftikhar Ahmed Babar, Rizwan Ahmed Khan, Ihsanur Rehman, Tanvirul Hassan Shirazi, Chaudhry Abdul Waheed, Ansar Farooq Chaudhry, Col (r) Tahir Lahoti, Muhammad Hashim Khan and Tauqir Ali Khan.
At the beginning of the hearing, Shahid Mehmood Abbasi, counsel for the ANF, submitted that ANF Force Commander Brigadier Fahim intended to withdraw the petition.
The CJP asked Fahim, “Who gave you authority to withdraw the case? Under what reasons you have decided to withdraw the petition? Something is wrong in the bottom.” The CJP asked him further, “Are you scared as you should set an example in this case?” Brigadier Fahim replied he was not scared and would not withdraw the case.
Fahim told the bench that after the investigation of the matter, Tauqir Ahmed Khan’s name was surfaced – who under the pretext of Musa’s personal secretary – got the quota approved. The Federal Health Ministry passed the quota in violation of rules.
Upon the CJP’s directions, he also read the inquiry committee’s report, saying that both the companies misused the quota and sold the ingredient to smugglers.
According to the report, every pharmaceutical company was entitled to get a quantity of 500kgs of the ingredient used in ephedrine, but the ministry ignored 20 companies and granted 9000kgs quota to only two companies.
The ANF deputy director told the court that he had issued a notice to Musa on March 12, 2011, adding that neither Musa nor Tauqir appeared so far.
The court adjourned the hearing until April 20.

Aitzaz Ahsan, who led the movement for the judiciary in 2008, has said that Supreme Court made an issue out of nothing in the contempt case. According to sources; Aitzaz reasoned that current bench has issued the contempt notice to PM Gilani, so now a new bench should take on the hearings from here. It is to be remembered that Aitzaz was one of the prominent leader of Lawyers Movement in the post Musharraf era. Further news can be seen in the following Image.

The two political leaders who accompanied Prime Minister of Pakistan Yousaf Raza Gilani to the Supreme Court on 19 January 2012 for his hearing, Chaudhry Shujaat Hussain and Asfandyar Wali Khan, were accompanying Mr Nawaz Sharif when he had to visit Supreme Court in 1997 for his hearing. Wow, How time changes.

ISLAMABAD: Pakistan Prime Minister Yousuf Raza Gilani today offered to resign shortly after the Supreme Court served him a notice for contempt of court for failing to reopen graft cases against the President, according to a media report.
Gilani told a meeting of top leaders of the Pakistan People's Party and its partners in the ruling coalition that he was ready to quit if the step strengthened the government and parliament, a news channel quoted its sources as saying.

A recent cable leak has shown that Mr Nawaz Sharif had pressingly reassured former US Ambassador in Pakistan,Ms N W Peterson,that he is a pro-American leader and this can be proved by the fact that in the Gulf War between Kuwait and Iraq,he sent a Pakistani Contingent to help US in the war which was against the wishes of former Army Chief General Aslam Baig. The cable says that Chaudhry Nisar was also with present with Nawaz Sharif. Further,what is shocking is this that Mr Sharif said to the ambassador that the best thing US did for Pakistan was to make General Ashfaq Pervez Kiyani the COAS. (Helllooo,we are supposed to appoint our COAS,Not US)
Another cable revealed that former Air Marshal Asghar Khan was also made Air Marshal on the advice of US. (US totally totally tells us what to do and who to appoint on important national strategic roles).A different cable revealed that Asif Zardari and Yousuf Raza Gilani had manifestly said to N W Peterson that they will forgive Musharraf, but only after presidential elections (because if they had forgiven Musharraf before presidential election,then Zardari would not have been able to nominate himself for the vacant position). The cable also unveils that Prime Minister Yusuf Raza Gilani said to Rehman Malik that as long as Drones were bombarding correct targets,he did not have any worries about that.The cable further tells that Prime Minister said that they would keep on protesting in the National Assembly to make a fool of the public,but would not oppose it to the US Govt.
